The monograph examines the philosophical aspects of guilt in criminal law, taking into account modern scientific achievements and the ongoing legal reform. The philosophy of guilt in criminal law is understood in terms of conceptual foundations, and is assimilated into theoretical views and practical approaches. It is important to return to the values of law that unite society. It is this moment that may become fundamental in determining the entire paradigm of the philosophy of criminal law. Humanity has long been thinking about the subjective components of socially dangerous behaviour. To correctly assess them, to penetrate into their deep essence means to implement the principles, purpose and objectives of Ukrainian criminal liability legislation, in particular, and the criminal law policy of our State in general. The author substantiates proposals for improvement of the current constitutional, criminal and criminal procedure legislation of Ukraine. The provisions and conclusions set out in the book may be taken into account in the legislative work of the Verkhovna Rada of Ukraine, in the practice of application by courts of the provisions of criminal and criminal procedure legislation of Ukraine, in further study of the mechanism of implementation of criminal law and analysis of the content of criminal liability, as well as in the educational process.
